I am sorry to hear that this patient suffered because their paperwork no longer reflected their wishes. You’re correct, you have no legal authority. The DPOA has that. It’s really unfortunate that the client didn’t talk w/ their DPOA regarding their change in priorities. It’s a tough situation because the person who is on the other line is only “doing their job” so I try to be as polite as possible and lean on the “we win together” approach.

There are always a lot of variables in each case and you don’t include specific info in your comment, but generally, if the person spent the night in the hospital or IRF (inpatient rehabilitation facility, aka acute rehab), it counts as a day whether or not they participated in rehab. Client’s rehab is stating his medicare days are up. He has not gotten the full benefit of his Physical Therapy due to his medical conditions hindering his progress. He was only able to participate every other day.
