One of my long-time clients is the VP of HR for a publicly traded company and he does put our fees for medical advocacy through his HSA account. It was his idea and I have always felt that if anyone should know if this is feasible, it would be someone with this background.

Sylvia and Neely – good question and yes, an accurate answer.
The answer for HSAs will end up, some day, being the same answer as to whether advocacy services are deductible on one’s taxes. It will require a ruling from a federal court – which has never happened.

Effective January 1, 2022 the Consolidated Appropriations Act of 2021 is now law in all 50 states.

Based on the Trish’s books and what I’ve listened to in the podcasts, it’s still a grey area with no hard and fast answer. Last summer was the most recent time I’ve looked into this though – perhaps something has changed?

I was discussing patient advocacy with a friend of mine who is a CPA and works as a training curriculum developer for a major company based in California. She was reviewing her company’s HSA coverage guidelines with me and felt there was some gray area.
