I have not heard this. I agree with having discussions, but if you are clear about your wishes, having them in writing ensures your healthcare POA will follow your wishes. I had a financial planner tell me she tells her clients not to sign a living will if they have healthcare power of attorneys. She said a signed living will is limiting to HCPOA. She agrees there should be discussions about wishes but no signature. Has anyone else heard this?

My 2 cents- If mom is and competent and is likely to remain competent, an important issue is whether disagreement exists or develops between Jane and the mom. That would place the advocate in a position of conflict. Then, it’s not so much about who pays (or agrees to pay), but rather, if the advocate can do his/her job regardless of payor.
