Success!!! They agreed to accept the EOB after I explained the situation and sent a letter saying we would file a NSA complaint to CMS and/or to the state Department oh Health.

She may have signed something indicating she understood that the facility or some of its providers are OON.

Good question. The EOB is from and medical pricer site MLIC which the insurance company uses.

Linda, my question is how an EOB exists if the ED is not contracted with insurance. Did the patient submit the claim to the insurance herself? If not, then the facility submitted it.

Not knowing the type of insurance, I cannot say for sure, but since most people’s insurance plans fall under the No Surprises Act, my weigh in is yes. The individual did not receive a good faith estimate and thus should not be required to pay a balance bill. They should file a complaint with CMS

My client gave her insurance card at the ER. She was treated for a minor injury and sent home. Then she received a bill for almost $8000. I sent in the EOB showing a patient balance of about $800. When I called they said they don’t contract with the insurance and don’t do settlements.
