Hello. I have a client who had a stroke and was admitted to UCLA (Los Angeles, CA) a few weeks ago.

The client is currently uninsured, but has emergency Medi-cal and may be placed on a family member’s insurance if the court will grant a temporary Conservatorship. Both the family and the hospital are having a difficult time finding placement in a post acute SNF. We are asking the hospital to keep the patient until we can find placement in post acute SNF

The family has prepared a letter stating why they are contesting the discharge. I know the hospital must present a discharge plan in writing to the family. Does anyone know how long the family has to find a SNF before the hospital can discharge the patient?

What are the reasons the hospital is unable to find a SNF?

            Hello,
I see it happen a lot where they try to discharge somebody out even though they never gave the family a list of places to check out. I have been able to stall discharge until we looked at places as a client’s right issue to participate in their care planning and I have had luck. If that time has run out and those steps weren’t taken, they can transfer the person out to a SNF-however, I believe if there’s an appeal filed, they may have to hold them during that appeal? Insurance isn’t my strong suit so hopefully someone else will chime in. Also, having temporary conservatorship over a person if they meet all the criteria to be conserved, does not constitute them going on a person‘s insurance. They have to be a dependent or a spouse or meet other criteria to go on that person‘s insurance. The conservatorship does not guarantee that. I hope some of this helped and good luck to you in your client

              Hello,

I’m in Ohio and this is something I have dealt with often.

I would ask the hospital’s case manager and patient relations team for the proposed discharge destination and care plan, a list of SNF referrals and responses, and the process for challenging the discharge.

I would also ask the hospital’s financial counselor to confirm exactly what the current Medi-Cal coverage will pay for and what coverage, if any, could become effective through the family member’s plan. That may help identify why facilities are declining and what needs to happen next. If the conservatorship hearing has not been scheduled, I would document that as part of the planning barrier and request a care conference with case management, the treating team, and the family as soon as possible.

              I hope this helps!
